A federal court has issued a preliminary injunction pausing HHS’ 340B Rebate Model Pilot program, which was supposed to launch on January 1stThe District Court for the District of Maine ruled that hospital groups suing over the new pilot will suffer “irreparable harm” should the plan launch as designed. HHS’ 340B Rebate Model would have overhauled the way 340B discounts are accessed currently by changing the timeline for receiving the 340B discount. 340B entities would be required to pay for the full cost of a drug at the time of purchase and receive the discount after dispensing the drug and submitting additional information to drug manufacturers.
